RE: The tariff classification of various rugs from Nepal and India

Dear Mr. Black:

In your letter dated November 19, 2008 you requested a classification ruling.

The submitted samples identified as Items 1-4 are rugs. Item 1 is a wool hand knotted rug. It has a cotton foundation. The wool knots are not cut creating a long pile on the surface of the rug. Item 2 is a hand knotted silk rug. It features a cotton foundation. The silk knots are sheared. Both rugs will measure 5’ x 7’ and will be made in Nepal.

Item 3 is a hand-tufted rug. It is made from wool yarns and viscose rayon yarns that are hand- tufted into a pre-existing woven base. A latex coating and secondary fabric backing have been applied. Item 4 is a hand woven rug with a stripe and star design. The rug is made from 100 percent cotton yarns. It is hand-woven with warp gaps and shared warps in a manner similar to a “Kelem” type construction. Although the majority of the rug consists of edge to edge stripes, the portion with the design uses discontinuous warps. Both rugs measure 5’ x 7’ and are made in India.

The applicable subheading for Item 1 will be 5701.10.4000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for carpets and other textile floor coverings, knotted, whether or not made up: of wool or fine animal hair: other: hand-hooked, that is, in which the tufts were inserted and knotted by hand or by means of a hand tool. The duty rate will be Free.

The applicable subheading for Item 2 will be 5701.90.1010, HTSUS, which provides for carpets and other textile floor coverings, knotted, whether or not made up: of other textile materials: with pile inserted and knotted during weaving or knitting... hand knotted. The rate of duty will be Free.   

The applicable subheading for Item 3 if the tufted pile is chief weight wool will be 5703.10.2000, HTSUS, which provides for carpets and other textile floor coverings, tufted, whether or not made up: of wool or fine animal hair: hand-hooked, that is, in which the tufts were inserted by hand or by means of a hand tool. The duty rate will be 6 percent ad valorem.

The applicable subheading for Item 3 if the tufted pile is in chief weight viscose will be 5703.30.2000, HTSUS, which provides for carpets and other textile floor coverings, tufted, whether or not made up: of other man-made textile materials: hand-hooked, that is, in which the tufts were inserted by hand or by means of a hand tool. The duty rate will be 6 percent ad valorem.

The applicable subheading for Item 4 will be 5702.10.9020, HTSUS, which provides for carpets and other textile floor coverings, woven, not tufted or flocked whether or not made up, including “Kelem”, “Schumacks”, “Karamanie” and similar hand-woven rugs; “Kelem”, “Schumacks”, “Karamanie” and similar hand-woven rugs: other… of cotton. The duty rate will be Free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
